Month to month, until timely cancellation.
Ask Bennett is purchased as an automatically renewing monthly business service unless an order states otherwise. A customer may stop the next renewal by completing cancellation before the next payment instruction is initiated. A renewal that has already been initiated remains due and purchases the next paid month.
Scope and Contract Documents
This Cancellation Policy applies to subscriptions for Ask Bennett website voice, chat, telephone, multilingual, support, implementation, usage, add-on, and related services that link to or incorporate this policy.
Ask Bennett is referred to as “Ask Bennett,” “we,” “us,” or “our.” The subscribing business, organization, or other customer is referred to as “Customer,” “you,” or “your.”
This policy is part of the Terms of Service and Service Agreement. The applicable checkout record, order, invoice, or signed amendment controls any negotiated price, billing frequency, minimum term, included usage, or cancellation method that expressly differs from this standard monthly policy.
Business Customers and Mandatory Rights
Ask Bennett is offered for commercial use by businesses and organizations. The person accepting the subscription represents that they are acting for business purposes and have authority to bind Customer.
A customer may nevertheless qualify for consumer, microenterprise, small-business, standard-form contract, automatic-renewal, cooling-off, withdrawal, payment, or unfair-term protections under applicable law. Nothing in this policy excludes a right or remedy that cannot lawfully be excluded.
If a mandatory local rule conflicts with this policy, the mandatory rule applies only to the extent required. The remaining provisions continue in effect.
Monthly Automatic Renewal
The subscription begins on the purchase, activation, or other start date shown at checkout, in the order, or in the account. It automatically renews for successive monthly billing periods until cancellation becomes effective.
Each renewal continues the same plan and authorized recurring charge, subject to usage, taxes, approved add-ons, and any price or plan change made under the Agreement. The subscription does not expire merely because Customer stops using Bennett, removes the widget, closes a website, changes staff, or no longer needs the service.
The renewed month is not a trial or a temporary hold. Once the payment instruction is initiated, the current renewal is governed by Sections 8 through 10 below.
Recurring Payment Authorization
By completing checkout, accepting an order, supplying a payment method, or otherwise authorizing recurring billing, Customer authorizes Ask Bennett and its payment processors to charge the credit card, debit card, or authorized business bank account kept on file for:
The recurring plan price due for each monthly billing period.
Usage, overage, add-on, telephone, integration, or other charges disclosed and authorized under the Agreement.
Applicable taxes, credits, processor adjustments, and other amounts lawfully due.
Reasonable retries after a declined, returned, reversed, or otherwise failed payment.
The authorization remains in effect until cancellation becomes effective and all outstanding amounts are paid. Customer represents that it is authorized to use the payment method and must keep accurate billing information and a valid payment method on file.
Billing Date and Renewal Time
The monthly renewal date is generally the same numerical day of the month as the original purchase or activation date. If a month does not contain that day, renewal may occur on the last day of that month. The account, checkout confirmation, invoice, or payment record may provide the controlling date.
For purposes of cancellation, a renewal is “initiated” when Ask Bennett or its payment processor submits the card, debit, bank-account, wallet, invoice, or other payment instruction for the new billing period. Settlement or posting by a financial institution may occur later.
Customer is responsible for reviewing the displayed renewal date and submitting cancellation early enough to prevent initiation. To reduce processing, authentication, bank, and time-zone risk, Customer should cancel at least twenty-four hours before a card renewal and at least three business days before a scheduled bank debit, unless the account provides a different operational cutoff.
How to Cancel
Customer may cancel through a direct cancellation control made available in the account, if available, or by sending a clear written request to [email protected] with the subject “Cancellation Request.”
The request should identify the business name, account email, website or location, and subscription to be cancelled. Do not send a full card number, full bank-account number, password, authentication code, or unnecessary sensitive information.
Ask Bennett may take reasonable steps to authenticate the request and prevent an unauthorized person from cancelling another business’s service. Authentication will not be used to obstruct or unnecessarily delay a valid cancellation.
Submit a cancellation request
Use the prepared email below. The email timestamp helps establish when the request was received. A cancellation request does not need a sales call, explanation, or retention conversation.
When Cancellation Is Effective
A valid cancellation received before the next renewal is initiated stops the next recurring subscription charge. The cancellation ordinarily becomes effective at the end of the current paid billing period, and service remains available through that date unless Customer requests earlier deactivation or Ask Bennett suspends the service under the Agreement.
A cancellation received after the renewal payment instruction has been initiated applies to the following renewal. It does not reverse, refund, or void the billing period that has already renewed.
A cancellation is not retroactive. It does not erase charges, usage, taxes, bank-return fees, processor costs, collection costs, or other amounts that became due before the cancellation effective date.
Payments Already Initiated or Processed
Once a renewal payment has been initiated or processed, Customer has purchased and committed to the next monthly billing period. The payment remains due even if it has not yet posted to Customer’s bank or card statement.
If the payment later settles successfully, service continues through the end of the paid period and cancellation becomes effective at that time. If the payment is declined, returned, reversed, or disputed, Sections 12 through 15 apply.
Ask Bennett may voluntarily stop or reverse a pending payment when technically possible, but is not required to do so after renewal has been initiated. A voluntary accommodation does not change this policy or create a future obligation.
| Situation | Result |
|---|---|
| Cancellation received before renewal is initiated | The next regular renewal is stopped. Service remains active through the current paid period. |
| Cancellation received after renewal is initiated | The current renewed month remains due and nonrefundable. Cancellation applies to the following renewal. |
| Payment method declines on renewal | The failed payment does not cancel the subscription. Ask Bennett may retry, suspend service, and collect amounts lawfully due. |
| Customer removes Bennett or stops using it | No cancellation occurs. Billing continues until a valid cancellation becomes effective. |
| Customer disputes or blocks the payment | The dispute is not a cancellation. Valid contractual charges and related remedies remain subject to the Agreement and applicable law. |
No Refunds, Proration, or Unused-Time Credits
Except where applicable law requires otherwise, all setup, implementation, subscription, renewal, usage, overage, telephone, add-on, integration, and other fees are final and nonrefundable once charged or earned.
Ask Bennett does not provide prorated refunds or credits for unused time, low usage, changed business needs, removed content, delayed launch caused by Customer, early discontinuation, failure to install or use Bennett, failure to cancel before renewal, loss of access caused by Customer systems, or termination for Customer breach.
A discretionary refund, courtesy credit, extension, or waiver may be offered in an individual case. It does not amend the Agreement, admit liability, or create a right to the same treatment in another case.
Access Through the Paid Billing Period
After a standard cancellation, Ask Bennett ordinarily keeps the service available through the end of the paid billing period. No further regular monthly renewal will be initiated after the cancellation becomes effective.
Customer remains responsible during the remaining period for website content, AI disclosures, consent, lawful use, account security, monitoring, and all other obligations under the Agreement.
Access may end earlier if Customer requests immediate deactivation, violates the Agreement, creates a security or legal risk, fails to pay, or if continued service is prohibited or impracticable. Early deactivation does not create a refund unless mandatory law requires one.
Actions That Do Not Cancel the Subscription
None of the following, by itself, is a valid cancellation:
Not opening the account, not speaking with Bennett, or not using included features.
Removing the widget, changing the website, disconnecting a phone number, or deleting an integration.
Deleting, locking, replacing, expiring, or closing a card or bank account.
Stopping a payment, revoking a debit mandate, disputing a charge, or initiating a chargeback.
Customer must complete the cancellation process in Section 6. Cancelling a payment authorization may change the permitted payment method, but does not by itself cancel the service contract or amounts already owed.
Failed Payments, Declines, and Retries
A declined, returned, reversed, expired, blocked, or otherwise failed payment does not cancel the subscription. Unless Ask Bennett elects otherwise, the account renews and the renewal amount becomes due on the scheduled renewal date.
Ask Bennett and its payment processors may retry the authorized payment method, use card-network account updater services, request another payment method, issue an invoice, or collect from another payment method that Customer has lawfully authorized for the account.
Ask Bennett may suspend or disable Bennett, withhold launch or support, restrict features, disconnect integrations, or terminate the account while an amount remains unpaid. Suspension does not waive the amount due and does not convert the renewed month into a free period.
Outstanding Amounts, Interest, and Lawful Collection
Customer remains responsible for valid subscription charges, approved usage, taxes, returned-payment charges, and processor fees caused by invalid payment information or a wrongful dispute, to the extent permitted by law.
Overdue amounts may accrue interest at the lesser of 1.5 percent per month or the maximum lawful rate after any legally required notice or grace period. Ask Bennett may recover reasonable collection costs, court costs, and attorneys’ fees to the extent permitted by the Agreement and applicable law.
Ask Bennett may pursue unpaid business debt through lawful internal collection, a collection agency, arbitration, court proceedings, or another remedy available in the jurisdiction connected to Customer or the transaction. Ask Bennett will not collect a future monthly period that never contractually renewed, but cancellation does not eliminate amounts already renewed, used, approved, or earned.
Chargebacks and Good-Faith Billing Disputes
A chargeback, payment reversal, stop-payment instruction, or bank dispute is not a cancellation request. Customer should contact Ask Bennett promptly about a good-faith billing issue and, where reasonably possible, allow an opportunity to investigate before disputing the charge.
Ask Bennett may respond to a dispute with the checkout acceptance, recurring-payment authorization, Agreement, account records, invoices, service records, usage records, communications, cancellation records, and other relevant evidence.
A knowingly false, abusive, or fraudulent chargeback is a material breach. Ask Bennett may suspend or terminate the account and pursue lawful recovery. Nothing in this section restricts a nonwaivable card-network, bank, payment-service, or statutory dispute right.
Authorized Bank Debits
When Customer authorizes ACH, pre-authorized debit, direct debit, or another bank-account payment, Customer represents that the account is a lawful business payment account and that the person providing authorization has authority over it.
Bank-payment instructions may be submitted before funds settle. A cancellation received after submission ordinarily cannot stop that debit and applies to the following renewal. Customer should follow the operational cutoff displayed in the account or payment authorization.
Revoking a bank-debit authorization stops future debits when processed, but does not automatically cancel the underlying Ask Bennett subscription or any amount already due. Customer must separately complete the cancellation process and arrange another lawful payment method for outstanding obligations.
Price, Tax, and Plan Changes
Ask Bennett may change a standard subscription price, included usage, plan configuration, or other recurring term by providing reasonable advance notice. A material change applies no earlier than the next renewal occurring after the notice period required by the Agreement or applicable law.
Customer may cancel before the changed price or plan becomes effective. Continued subscription after the effective renewal constitutes acceptance of the change.
Taxes may change because of law, location, registration status, exchange rates, or tax-provider calculations. A legally required tax change is not a discretionary price increase and may apply when required.
Trials, Discounts, Credits, and Promotions
If Ask Bennett offers a free trial, discounted period, promotional credit, or deferred start, the checkout or order will state the duration, price after the promotion, renewal date, and cancellation requirements.
Unless the offer expressly states otherwise, the subscription automatically converts to the standard paid monthly plan and continues until cancellation. Customer must cancel before the first paid payment is initiated to avoid that charge.
Promotional credits have no cash value, are not refundable, and may expire or be forfeited upon cancellation. Mandatory trial-end reminders, cooling-off rights, or refunds will be provided where required by law.
Requests for Immediate Deactivation
Customer may ask Ask Bennett to deactivate the service before the end of the paid billing period. Ask Bennett may process the request immediately or within a reasonable operational period.
Immediate deactivation stops access earlier but does not create a refund, credit, or proration for the remaining paid time. Customer should export any information it is entitled to retain before requesting immediate deactivation.
Ask Bennett may retain records as required for payment, security, legal, backup, dispute, fraud-prevention, and privacy obligations, subject to the Privacy Policy and Data Processing Addendum.
Suspension or Termination by Ask Bennett
Ask Bennett may suspend or terminate service for nonpayment, security risk, unlawful use, infringement, fraud, abuse, prohibited content, platform requirements, legal process, breach of the Agreement, or another reason allowed by the Terms of Service or Service Agreement.
If termination results from Customer breach, nonpayment, unlawful use, or risk created by Customer, charges already paid or due remain nonrefundable except where law requires otherwise.
If Ask Bennett permanently discontinues the paid service for convenience and Customer is not in breach, Ask Bennett may provide notice, continued access through the paid period, a substitute service, or a prorated credit or refund for materially undelivered prepaid service, as appropriate and as required by law.
Service Issues, Errors, and Requested Credits
A service interruption, AI error, inaccurate response, browser issue, integration failure, carrier problem, third-party outage, or other service issue does not automatically cancel the subscription or create a refund.
Customer must report a material billing or service issue promptly and provide reasonable information for investigation. Ask Bennett may correct the issue, restore service, modify configuration, provide a reasonable service extension or credit, or apply another remedy stated in the Agreement.
Any nonwaivable consumer guarantee, statutory conformity right, or mandatory remedy remains available to the extent applicable. The AI-specific limitations and responsibilities are explained in the AI Voice Disclosure.
Cancellation Confirmation and Records
Ask Bennett will send an electronic confirmation after a valid cancellation is processed. The confirmation may state the cancellation date, last day of service, final regular renewal status, and any outstanding amount.
Customer should retain the cancellation request and confirmation. If Customer does not receive confirmation within two business days, Customer should follow up using [email protected] or (888) 515-8088.
Ask Bennett may retain evidence of enrollment, recurring-payment consent, renewals, cancellation, authentication, billing, disputes, and communications for legal, payment, accounting, security, and defense purposes.
United States Standards
For covered online consumer transactions, the Restore Online Shoppers’ Confidence Act requires clear disclosure of material terms, express informed consent before charging, and a simple mechanism to stop recurring charges. The Federal Trade Commission Act and state unfair or deceptive practices laws also prohibit misleading enrollment, billing, and cancellation practices.
The FTC’s broader 2024 Click-to-Cancel rule was vacated, and the FTC began a new negative-option rulemaking process in March 2026. Ask Bennett nevertheless intends to provide clear recurring-payment terms, affirmative authorization, a retainable acknowledgment, and a cancellation method that is easy to locate and use.
State automatic-renewal laws may impose additional requirements. California law, for example, applies to covered consumer transactions and requires clear terms, affirmative consent, acknowledgment, easy online cancellation for online enrollment, and specified notices. These consumer statutes may not apply to a purely business purchase, but Ask Bennett will provide the required protection whenever applicable.
United Kingdom, Ireland, and European Economic Area
The parties intend the service for business use. A natural person acting mainly outside a trade, business, craft, or profession may have mandatory consumer rights, including pre-contract information, fair terms, cancellation or withdrawal rights, and remedies that cannot be waived.
Where EU or Irish consumer law applies to a distance service contract, a qualifying consumer may have a fourteen-day withdrawal right, subject to exceptions and rules concerning a request to begin performance before the withdrawal period ends. Ask Bennett will provide any required withdrawal form, refund, proportionate charge, or other remedy.
The United Kingdom’s Digital Markets, Competition and Consumers Act 2024 contains a new subscription-contract regime. As of this policy’s effective date, the UK Government expects those subscription measures to begin in Spring 2027. Ask Bennett will update its checkout, reminders, cancellation process, cooling-off treatment, and refunds when those rules become applicable.
Canada
Canadian federal competition law and provincial or territorial consumer-protection laws prohibit materially false or misleading subscription representations and may require clear terms, consent, notice, cancellation rights, or refunds for qualifying consumer transactions.
For Canadian pre-authorized debits, the applicable payment authorization and financial-institution rules may provide a right to cancel the debit authorization and dispute an unauthorized or noncompliant debit. Cancelling the debit authorization does not itself cancel the Ask Bennett service contract or an amount lawfully owed.
Ask Bennett will apply any mandatory provincial cooling-off, internet-agreement, renewal, unfair-practice, or refund right to the extent Customer qualifies and the law applies.
Australia
The Australian Consumer Law prohibits misleading conduct and unfair terms in covered standard-form consumer and small-business contracts. The ACCC’s 2026-2027 enforcement priorities specifically include harmful cancellation terms involving automatic renewals, early termination fees, and non-cancellation clauses.
This policy uses a month-to-month model, permits cancellation before the next renewal, does not impose an early termination fee for a standard monthly plan, and does not require a long notice period. A completed monthly renewal remains payable and nonrefundable only to the extent the term is transparent, reasonably necessary to protect legitimate interests, and lawful in the circumstances.
Nothing in this policy excludes a consumer guarantee, small-business protection, or remedy that cannot lawfully be excluded under Australian law.
New Zealand
New Zealand’s Fair Trading Act prohibits misleading conduct, unconscionable conduct, and unfair terms in covered standard-form consumer and small trade contracts. Automatic-renewal terms should be clear from the beginning and should not use hidden renewal, excessive notice, penalty-like fees, or unnecessary barriers to cancellation.
Ask Bennett’s standard monthly plan may be cancelled before the next renewal without an early termination fee. If mandatory New Zealand law gives a qualifying customer a right to cancel after renewal, a refund, or another remedy, that right applies.
Nothing in this policy limits a right under the Consumer Guarantees Act or Fair Trading Act that cannot lawfully be contracted out of, except where lawful business contracting-out requirements are fully satisfied.
Changes to This Cancellation Policy
Ask Bennett may update this policy for legal, payment, security, operational, product, or business reasons. The revised policy will display a new effective date.
A material change to recurring price, renewal, cancellation, refund, or payment terms will receive reasonable advance notice and will apply no earlier than the next renewal after the notice period required by law or the Agreement.
Customer may cancel before the material change becomes effective. An update will not retroactively make a previously authorized charge unauthorized or remove a right that had already accrued.
